Thank you for using XAG Agricultural Service Management Platform and services.
Please carefully read the User Agreement, Privacy Policy and other relevant documents before using the Platform and services, especially the contents marked in bold form and the corresponding terms of exemption or limitation of liability, including the separate agreement for opening or using a certain service.Unless you accept all the terms of this Agreement, you are not authorized to register, log in, or use the services covered by this Agreement. Your registration, login, use and other behaviors will be deemed to be your acceptance of this Agreement and your agreement to be bound by the terms of this Agreement. You understand and agree that XAG may update this Agreement at any time according to changes in the Platform and Services, and you can check the latest version of the Agreement on the Platform. If you do not accept the modified terms after the terms of the Agreement are updated, please stop using the Platform and the Services immediately, and continued use will be deemed to have accepted the modified Agreement.
I. Scope of this Agreement
1. This Agreement is an agreement between you and XAG regarding the use of XAG Agricultural Service Management Platform and services. "XAG" refers to the operational affiliates that may exist in XAG and its related services. You, i.e., the "User", refer to the individual or organization that has applied for the certification service of XAG Agricultural Service Management Platform and/or has been successfully certified.
2. The content of this Agreement also includes the relevant agreements, service statements, business rules and announcement guidelines that XAG may issue on an ongoing basis regarding the Services(as Special Rules).Once the above content is officially released, it shall be an integral part of this Agreement, and you and XAG shall abide by it as well.
II. Account registration
1. Before you can use this platform and service, you need to register an account, and the account number is your real-name verified mobile phone number. Please ensure that the mobile phone number you use is available normally during registration and use. At the same time, you agree to allow your mobile phone number and mobile device identification code and other information to be used for registration when registering on the Platform.
2. During the registration of an account and the use of this service, XAG needs to collect personal information that can identify users so that they can contact users when necessary or provide you with a better user experience. XAG's collection, use and processing of your information is subject to the Privacy Policy issued by XAG.
III. Land plot import function
The land plot import function means that you can import the land plots created by the third-party platform to the XAG user app, and you can use this function to upload and import them.
1. Before uploading documents related to third-party plots, you should ensure the legality, accuracy and validity of the documents to be uploaded; XAG does not assume any responsibility for the legality, accuracy and validity of the documents you upload.
2. If there is any change in the uploaded plot (including but not limited to: obstacle changes, plot boundary changes, etc.), XAG recommends that you should re-upload the relevant documents of the plot, otherwise it may cause adverse consequences such as mismatch with the actual plot situation.
3. You shall ensure that you have the right to carry out surveying, mapping, operation and management of the current plot, and there is no infringement of the legitimate rights and interests of others. If you have any illegal behavior, XAG has the right to suspend your use of this function without any liability to you.
IV. Rules of Use
1. Any content you transmit or publish through the Platform and Services does not reflect or represent XAG's views, positions or policies, and XAG does not assume any responsibility for the content you upload.
2. You shall not use the Platform or the Services to do the following:
(1) Submitting or publishing false information, or stealing other people's avatars or materials, impersonating or using the names of others;
(2) Coercing or inducing other users to follow, click on linked pages or share information;
(3) Fabricating facts or concealing the truth to mislead or deceive others;
(4) Using technical means to establish fake accounts in batches;
(5) Using this account or this service to engage in any illegal or criminal activities;
(6) Making, publishing, or operating or disseminating methods and tools related to the above acts, regardless of whether these acts are for commercial purposes;
(7) Other behaviors that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of the Platform, or are not expressly authorized by XAG.
V. Specifications for Content Distribution
1. The content mentioned in this article refers to any content produced, uploaded, reproduced, published and disseminated by you in the course of using the Platform, including but not limited to registration information and authentication materials such as account avatar and name, or text, voice, pictures, videos, graphics and other messages sent, replied to or automatically replied to messages and related link pages, as well as other content generated by using the Platform or the Services.
2. You shall not use the Platform or the Services to produce, upload, copy, publish, or disseminate content prohibited by the following laws, regulations, and policies:
(1) Opposing the basic principles set forth in the Constitution;
(2) Endangering national security, divulging state secrets, subverting state power, or undermining national unity;
(3) harming the honor and interests of the state;
(4) Inciting ethnic hatred and ethnic discrimination, or undermining national unity;
(5) Undermining the state's religious policies and advocating cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, or undermining social stability;
(7) Disseminating obscenity, pornography, gambling, violence, murder, terror or instigating crimes;
(8) Insulting or slandering others, infringing upon the legitimate rights and interests of others;
(9) Information containing other content prohibited by laws and administrative regulations.
3.You shall not use the Platform or the Services to produce, upload, copy, publish, or disseminate the following content that interferes with normal operations and infringes upon the legitimate rights and interests of other users or third parties:
(1) contains any sexual or sexually suggestive substance;
(2) Contains abusive, intimidating, or threatening content;
(3) Contains harassment, spam, malicious information, or deceptive information;
(4) Involving the privacy, personal information or data of others;
(5) Infringing upon the legitimate rights of others, such as the right of reputation, portrait right, intellectual property rights, and trade secrets;
(6) Contains other information that interferes with the normal operation of the service and infringes on the legitimate rights and interests of other users or third parties.
VI. Miscellaneous Supplemental Terms
1. XAG Agricultural Service Management Platform is a platform that integrates data synchronization, storage, and access, and all data is set by users themselves or generated by other XAG terminal devices. Each user shall promise the authenticity and legitimacy of the data generated. If a civil dispute arises between users due to the authenticity and legitimacy of the data when using the Platform, it shall be resolved by the users themselves, and has nothing to do with XAG and the Platform.
2. The validity, interpretation and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If any dispute or controversy arises between the two parties, it shall first be settled through friendly negotiation, and if the negotiation fails, both parties agree to submit it to the court of the region where XAG is located.
3. If any provision of this Agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding upon both parties.
